Acceptable Use Policy

This acceptable use policy (“Acceptable Use Policy”) applies to the ChainHost website located at www.ChainHost.com, and all associated sites linked to www.ChainHost.com by ChainHost, its subsidiaries and affiliates (those sites, the “Site”). The Site is owned and operated by Dynamic Computers LTD LLC (“ChainHost”). The acceptable use policy also incorporates by reference the Terms of Use, the User Agreement and the Fees and Credit Policy also available at the Site. The Acceptable Use Policy also incorporates by reference the Terms of Use, the User Agreement, The Privacy Policy and the Fees and Credit Policy also available at the Site. BY USING THE SITE, YOU AGREE TO THE ACCEPTABLE USE POLICY. IF YOU DISAGREE WITH THE ACCEPTABLE USE POLICY, DO NOT USE THIS SITE.

The Site reserves the right, at its sole discretion, to change, modify, add or remove portions of this Acceptable Use Policy, at any time. You are responsible for periodically reviewing the Acceptable Use Policy for changes. By continuing to use the Site, you accept any changes at the time they are implemented.

The Site is to be used only for lawful purposes. You must maintain your hosted files in full compliance with the the Site’s Terms of Use. If any part of your account violates this Acceptable Use Policy, the Site may take immediate action to correct the violation, which may include immediate suspension or deletion, from your account without prior warning. If you abuse this Acceptable Use Policy, your account will be subject to being warned, suspension or possible account termination, and you will receive no refund.

By using the Site, you agree:

You will not violate Federal, State or local laws, regulations, ordinances or any other requirements imposed by any applicable government.

You will not transmit any unsolicited commercial or bulk email. This includes any activity known or considered to be “spamming” or “Mail Bombing”.

You will not make, attempt or allow unauthorized access to the Site, its servers, your own hosting account or the account of any other registered user of the Site.

You will not use or allow any remote code execution of malicious software through the hosting account provided by the Site.

You will not cause or allow denial of service attacks, port scans or other endangering and invasive procedures against the Site’s servers and facilities or the servers and facilities of other network hosts or Internet users.

You will not forge the signature or other identifying mark or code of any other person or engage in any activity (including "spoofing") to attempt to deceive other persons regarding your true identity (excluding the use of anonymous remailers or Internet nicknames)

You will not use the account provided by the Site for storing or transmitting any data (by e-mail, uploading, posting,hot linking, directly linking, or otherwise) that infringes any copyright, trademark, patent, trade secret or other proprietary rights of any third party, including, but not limited to, the unauthorized copying of copyrighted material, the digitization and distribution of photographs from magazines, books, or other copyrighted sources, and the unauthorized transmittal of copyrighted software.

You agree that you will not use the Site and the services provided to host content, links or advertisements directly or that of other websites that:
    - Infringe any copyright, trademark, patent, trade secret, or other proprietary rights of any third party information;
    - profess hatred for particular social, ethnical, religious or other group;
    - Contain viruses, Trojan horses, worms, time bombs, corrupted files, or any other similar software or programs
    - Host any content which can be used to damage the operation of a computer or a person's property;
    - Illegal or Hacking/Phreaking Software (Warez) - Any software that is copyrighted and not freely available for distribution without cost.
    - Hosting of ROMs, ROM Emulators and Mpeg Layer 3 files (MP3) where you are not the author of the content contained;
    - A proxy server or other traffic relaying programs of any kind;
    - Promotion of Money Making Schemes, Multi-level Marketing, Ponzi or any similar activities;
    - Promote, list, provide or catalog Torrent trackers, Torrent Portals or similar software;
    - Adult content in a location where adult content is not allowed
    - Any content that can be deemed obscene, is unlawfully harassing, or connected with child abuse or sex-related merchandising;
    - Any content that is violent or encourages violence or hate.

Examples of unacceptable materials on all the Site’s servers include:
IRC Bots, IRC servers, IRC Clients, Proxy Scripts, Warez, image dumps, filedumps, mirror without chainhost approval, or banner-ad services (similar to rapidshare, photobucket, or commercial banner ad rotation), topsites, commercial audio streaming, Escrow, High-Yield Interest Programs (HYIP) or related sites, Investment sites where prospectus and related regulatory filings have not been provided, sale of any controlled substances without providing proof of appropriate permit(s) in advance, AutoSurf sites, Bank Debentures, Bank Debenture Trading Programs, Prime Banks Programs, lottery sites, muds / rpg's, hate sites, hacking focused sites/archives/programs, or sites promoting illegal activities, IP Scanners, Brute Force Programs, Mail Bombers and Spam Scripts. Forum sites and or any other websites that distribute or link to warez content are strictly prohibited as well.

The Site may refuse service to anyone in the Site’s sole discretion. Any material deemed by the Site to be either obscene or threatening is strictly prohibited and will be removed from its servers immediately with or without prior notice and may lead to warning, suspension or immediate account termination with no refund.

You may not cause harm to the Site or other registered users of the Site. You are also responsible for the hosting accounts in your package. You must ensure that they will not be used to cause harm to the Site or other registered users. Failure by you, or those using a hosted account in your package, to comply with the policy above may result in warning, suspension or possible termination of your package with no refund. The Site has the right to decide in good faith which actions cause harm as well as the size of the penalty fee or the severity of any other corrective action to be applied.

You are responsible for ensuring the security of your account, directories and files by setting all permissions and files properly for all programs and scripts installed under your account. The Site recommends setting all permissions within your account as restrictive as possible. You are responsible for all aspects of your hosting accounts. This includes compatibility with the Site’s hardware and software. If you have questions regarding the hardware or software, refer to your account or contact Customer Service. It is your responsibility to keep your content and those using your hosted account in your package content compatible at all times. The Site is not responsible for any malfunctioning or any damages to the content of any hosting account in your Package, caused by your failure to ensure content compatibility with the hardware and software used by the Site.

You are responsible for ensuring legal compliance for all contents of your hosting account or those using your hosted account comply with any specific legal act or provision. The Site will not be liable for failure on your part to comply with this requirement.

The Site has sole discretion to determine what constitutes a violation of this Acceptable Use Policy and the appropriate remedy for such violation. If there is a violation of this Acceptable Use Policy, the Site may take corrective action at its discretion and will notify you when such action has been taken. The Site is not liable for any loss or damage arising from steps taken to correct a violation of this Acceptable Use Policy.

You understand and agree that if you choose to reactivate your account suspended for violation of this Acceptable Use Policy, a reactivation fee may be applied.

You will be permitted seven (3) calendar days to correct any violation after suspension of your account. If you fail to cure the violation, The Site has the right to terminate your account. If your account is terminated, any backup copies of your account will be permanently deleted and you will receive no refund. The Site will not be liable for any loss or damages in such cases.

Notification of Violation

It is your responsibility to comply with all of the Terms of Use, including this Acceptable Use Policy. The Site is under no obligation to notify you before taking corrective action for a violation of this Acceptable Use Policy. Your account may be terminated immediately if the Site determines that your activity is causing harm to parties on the Internet. In extreme cases, law enforcement will be contacted regarding the activity. No credit will be issued for the time the your account is suspended.

Security Violations

You are responsible for any misuse of your account, even if the inappropriate activity was committed by a friend, family member, guest or employee.

INDIRECT OR ATTEMPTED VIOLATIONS OF THE POLICY, AND ACTUAL OR ATTEMPTED VIOLATIONS BY A THIRD PARTY ON YOUR BEHALF OR YOUR END USER, SHALL BE CONSIDERED VIOLATIONS OF THE POLICY BY YOU.

Feedback and Information

Any feedback you provide regarding the Site is not considered confidential. ChainHost is free to use such information without restriction.
